A January 8 chief Court decision limiting the latitude of file Americans With Disabilities Act could make the workplace a tougher place for race with HIV.

In the case, which involved a former assembly-line worker with carpal subterranean passage syndrome, the court ruled that "merely having an impairment does not make undivided disabled for the purposes of the ADA."

This may limit the ability of the bulk of mankind with HIV to seek ADA assistance--either for protection from discrimination or for workplace accommodations, according to Lambda Legal Defense and Education Fund

"The court is leaning toward a definition of disability that is not alone a moving target but also a remarkably small one," Lambda's Catherine Hanssens said. "It's getting harder for the community with HIV to hit that mark."
