A gay death-row inmate whose lawyer slept by the and of portions of his murder trial will now memorize a new trial. The U chief Court on June 3 threw disclosed an appeal from Texas authorities, who argued that the capital slay conviction of Calvin Burdine should stand despite the inattention of his court-appointed attorney, Joe Cannon.

Burdine initially admited to stabbing to death his partner, WT Wise, at the Houston trailer they shared in 1983 if it be not that he now claims an accomplice killed Wise. Jurors and a court saleswoman described how Cannon slept for up to 10 minutes at a time during the 1984 trial.
